These Terms of Sale govern all purchase agreements concluded between Stavholt and its customers. By submitting an order on our website, you confirm that you have read, understood and accepted all terms below, together with our Shipping Policy, Return & Refund Policy, Legal Disclaimer and Privacy Policy. These terms comply with French commercial law and the EU Consumer Rights Directive.

1. Parties and Contract Formation

1.1 The seller is Stavholt, with contact and address information listed above. The buyer is any natural person or legal entity placing an order on our website. 1.2 When you submit an order and complete payment, you submit an offer to purchase goods. A binding sales contract is formed only after Stavholt sends you an official order confirmation email. 1.3 Stavholt reserves the right to refuse or cancel any order at our discretion, including cases of suspected fraud, incorrect pricing, out-of-stock products, invalid shipping address or violation of these terms. Full refunds will be issued for all cancelled paid orders.

2. Product Information and Pricing

2.1 Product photos, descriptions, sizes and specifications are for reference only. Minor visual differences caused by screen settings, lighting and normal manufacturing batch variations shall not be regarded as product defects. 2.2 All prices displayed on the website are in Euro (EUR), including French VAT for orders delivered to Metropolitan France. For shipments to other EU countries or outside the EU, local VAT, customs duties or import taxes may apply and shall be borne by the customer. 2.3 Shipping fees are calculated separately and displayed on the checkout page. 2.4 Stavholt reserves the right to adjust product prices and promotional activities at any time. Price changes will not affect confirmed orders. In the event of obvious technical pricing errors, we have the right to cancel the order and refund the full payment.

3. Payment Terms

3.1 We accept payment methods displayed at checkout. Order processing starts only after full payment is received. 3.2 You warrant that you are the lawful holder of the payment method used and all payment information you provide is true and valid. 3.3 If payment is declined, rejected or disputed without valid grounds, Stavholt reserves the right to suspend shipment, cancel the order and claim compensation for resulting losses.

4. Order Fulfilment and Delivery

4.1 Order processing and delivery shall follow our published Shipping Policy. All delivery times are estimates and not guaranteed. 4.2 It is the customer’s responsibility to provide a complete and accurate delivery address. Stavholt shall not be liable for delivery failures caused by incomplete or incorrect address information provided by the buyer. 4.3 Ownership of goods transfers to the customer after full payment is received and the parcel is successfully delivered. Risk of loss or damage to the goods passes to the customer once the package is handed over to the logistics carrier.

5. Right of Withdrawal and Returns

5.1 EU consumers have a statutory 14-day cooling-off period to withdraw from the contract without giving reasons, starting on the day you receive the goods. 5.2 To exercise the withdrawal right, you must notify us by email within the 14-day period. You shall return the goods at your own cost, in original condition and original packaging. 5.3 Exemptions to the withdrawal right apply for custom-made goods, sealed hygiene items that have been opened, digital goods or perishable goods, in accordance with EU consumer law. 5.4 Refunds will be processed after we receive and inspect the returned goods. Original shipping costs may be deducted according to our Return & Refund Policy.

6. Product Warranty

6.1 Our products are covered by statutory warranty in accordance with French consumer law, covering manufacturing defects. 6.2 The warranty does not cover damage caused by improper use, accidental impact, unauthorised modification, normal wear and tear, incorrect installation or failure to follow product instructions. 6.3 If you receive defective goods, please contact us within the time limit specified in our Shipping Policy and provide required evidence such as photos. We will arrange remedy by repair, replacement or refund at our discretion.

7. Intellectual Property

All trademarks, texts, images, graphics and designs on the website belong to Stavholt. You may not copy, reproduce or use any of our intellectual property for commercial purposes without prior written consent.

8. Limitation of Liability

Subject to mandatory provisions of French and EU law, Stavholt shall not be liable for indirect, consequential, incidental or economic losses including loss of profit, loss of use and business interruption arising from the goods. Nothing in these terms limits liability for death, personal injury caused by negligence, fraud or mandatory statutory consumer rights.

9. Force Majeure

Stavholt shall not be liable for delays or failure to perform obligations caused by events beyond our reasonable control, including natural disasters, pandemic, carrier strikes, customs delays and government restrictions. We will notify customers as soon as reasonably possible and suspend order performance until the event ends.

10. Dispute Resolution and Governing Law

These Terms of Sale are governed by the laws of France. Any disputes shall first be resolved by friendly negotiation. If negotiation fails, disputes shall be submitted to the competent courts in France. EU consumers may also use the European Online Dispute Resolution platform for out-of-court dispute settlement.

11. Amendment of Terms

Stavholt reserves the right to update these Terms of Sale. Updated terms will be published on the website. Changes do not apply to orders confirmed before the update date.
